Bankruptcy and Consumer Proposal FAQs
Upon filing of a Notice of Bankruptcy or Consumer Proposal, in which 407 ETR is listed as a creditor, 407 ETR will remove from plate denial any amounts still owing from the period prior to your assignment into Bankruptcy, or filing of Consumer Proposal (which includes interest and any fees incurred on those amounts). The Ministry of Transportation will be advised to update their records to reflect this adjustment.
You may be removed from plate denial if:
- you have not incurred any new debt with 407 ETR for which you may be in plate denial since your assignment into Bankruptcy or filing of Consumer Proposal; and
- you have no other debts with the Ministry of Transportation (e.g. parking tickets) for which plate denial is in effect.
Questions and Answers
1) How do I advise 407 ETR about my Bankruptcy or Consumer Proposal filed?
Please have your Trustee in Bankruptcy or Proposal Administrator contact our office. Your Trustee in Bankruptcy or Proposal Administrator will communicate with 407 ETR, if 407 ETR is listed as a creditor in your Bankruptcy or Consumer Proposal.
407 ETR requires a copy of your Notice of Bankruptcy or Consumer Proposal to determine whether any amounts may be adjusted on your account.
2) Where will 407 ETR send information to me?
407 ETR will send information directly to your Trustee in Bankruptcy or Proposal Administrator
3) Where and how do I send the materials? Can I drop it off?
Your Trustee in Bankruptcy or Consumer Proposal Administrator will communicate with creditors, including 407 ETR, if 407 ETR is listed as a creditor in your Bankruptcy or Consumer Proposal.
4) I want plate denial lifted on an expedited basis. How can that be done?
If your Trustee or Proposal Administrator has provided 407 ETR with your Notice of Bankruptcy or Consumer Proposal, we will send your Trustee or Proposal Administrator a letter within 10 business days of receipt of these documents confirming any amounts that were adjusted on your account. If the Ministry of Transportation was previously notified of the failure to pay any portion of this debt, the Ministry of Transportation will promptly be notified of any adjustments. Should you require an expedited review, please have our Trustee in Bankruptcy or Proposal Administrator contact the 407 ETR Bankruptcy Department (see below) and we will endeavor to facilitate your request.

5) I don't know if 407 ETR has my Notice of Bankruptcy or Consumer Proposal and my Bankruptcy or Consumer Proposal was completed some time ago. Can you please check for me and tell me?
407 ETR has undertaken a review of its files and has communicated in writing with those persons who have previously informed 407 ETR regarding their Bankruptcy or Consumer Proposal. If you need to speak with us, please contact 407 ETR’s Bankruptcy Department (see below).
6) My Bankruptcy or Consumer Proposal is complete. I received a letter in the mail from 407 ETR that says my account is being adjusted for amounts still owing from the period prior to my Bankruptcy or Consumer Proposal. Do I owe any other money to 407 ETR? If so, how much and why do I owe it?
If you have a balance owing on your account, you will receive an invoice on your next bill cycle that will show the amount adjusted on your account as well as any balance still owing. Please be advised that any use or charges incurred following the filing of your Notice of Bankruptcy or Consumer Proposal continue to be your responsibility.
7) I heard there is a class action against 407 ETR regarding Bankrupt persons. How does this affect me?
