Pre-authorized Credit Card Agreement
The following terms and conditions apply to pre-authorized credit card payments. 407 ETR may update these terms and conditions at any time and will provide notice to you of any material changes. Your continued use of the toll highway or lease of a transponder shall constitute your acceptance of these changes.
In accordance with this pre-authorized credit card (PAC) agreement (this “Agreement”), you hereby authorize 407 ETR Concession Company Limited (“407 ETR”) to begin charging the specified credit card as per your instructions for variable monthly payments, for payment of all tolls, fees and other charges related to travel on the toll highway. In so doing, you represent that you have the authority to grant such authorization and are acting in accordance with the terms of your credit card agreement. You also consent to the disclosure of personal information, as applicable, for PAC processing.
Variable monthly payments for the full amount owing to 407 ETR will be charged to the specified credit card 10 calendar days from the date of your bill. In the event 407 ETR is unable to mail, deliver or send your bill to you due to events beyond our reasonable control including, and without limitation, strikes or labour disputes (e.g., postal strike), you hereby acknowledge and agree that amounts incurred by you may still be charged and are payable in full on the credit card transaction date even if the corresponding bill cannot be delivered to you. You may contact us at any time to inquire about such charges including, if applicable, to request a reversal or adjustment within sixty (60) days of the transaction date.
It is your responsibility to ensure that you have an active and valid credit card on file with us and that your information is up to date. If a PAC payment is rejected due to issues with your credit card, you will automatically be removed from PAC processing and this Agreement will terminate. You acknowledge that 407 ETR is not obligated to notify you of issues with your credit card, such as its expiry, and is not responsible for any resulting consequences. If PAC processing ceases, you must ensure amounts owed to us are paid by other methods (described at 407etr.com) unless and until you register for PAC processing again. Where circumstances permit, 407 ETR may in its discretion and without notice, continue PAC processing for amounts owing notwithstanding an expired credit card (e.g., if you begin using a renewal credit card bearing the same numbers but fail to update us).
You may cancel your authorization or revoke this Agreement by giving 407 ETR written or (authenticated) verbal instructions at least 10 calendar days before the next scheduled PAC transaction. Upon receiving such instructions, 407 ETR will use best efforts to stop the transaction before the next billing cycle and, in any case, within 30 calendar days of receiving your notice.
407 ETR may cease PAC processing or revoke this Agreement upon 30 calendar days’ written notice to you specifying the date of the final PAC charge and the effective termination date of this Agreement.
407 ETR may assign this Agreement, including any or all of its rights and obligations hereunder by providing you prior written notice of such assignment, including the identity and contact information of the assignee, at least 10 calendar days before any PAC charge in the assignee’s name.

This Agreement is governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada. Both parties consent to the non-exclusive jurisdiction of Ontario courts for the purpose of any action or proceeding brought by either of them in connection with or arising out of this Agreement.
