What is ETR Rewards

ETR Rewards is a loyalty rewards program offered by 407 ETR Concession Company Limited (“407 ETR”) under these terms and conditions (the “Terms”). The program gives you the opportunity to earn and redeem reward points when you travel on Highway 407 ETR. Any references to “you” and “your” mean you, the customer, and “us” and “we” mean 407 ETR. By participating in any aspect of ETR Rewards, you agree to be bound by the Terms, which may change from time to time pursuant to Section 6 (Changes to ETR Rewards). How to Participate

To participate in ETR Rewards, you must meet the following program requirements:

Be an individual who is a resident of Canada or the United States and be of the age of majority in your province or state of residence.

Have a My Account and agree to the My Account & Paperless Agreement.

If you haven’t yet, register for paperless billing and important payment notices.

Use the 407 ETR Mobile Application (the “App”) and agree to the 407 ETR Mobile Application Terms of Use.

Link your My Account to one or more vehicles (less than 5,000 kg) attached to licence plates you are the registered owner of (a “Qualifying Vehicle”). Please note, a Qualifying Vehicle excludes vehicles attached to licence plates registered to other people even if they are part of your household or their accounts are consolidated under One Simple Bill.

ETR Rewards is available to individuals who enroll separately and satisfy all program requirements, including individuals who sign-up to One Simple Bill (see One Simple Bill Terms and Conditions). ETR Rewards is not available to corporations, businesses, charities, partnerships, enterprises, or anyone else identified by 407 ETR as ineligible, in its sole discretion.

Earning Reward Points

Eligible Trips on Highway 407 ETR

10 reward points are earned based on each dollar you spend taking an Eligible Trip. This means that toll charges, trip toll charges, and camera charges all earn you reward points. However, reward points are not earned on account fees, transponder lease fees, interest charges, unrecognizable plate charges or non-sufficient fund (NSF) fees. The reward points you earn will be redeemable for trips at a specific rate determined by 407 ETR and identified in the App. For redemption details, please see Section 4 (Redeeming Reward Points).

An “Eligible Trip” refers to any trip on Highway 407 ETR you take in a Qualifying Vehicle, except a trip taken:

prior to successfully enrolling in ETR Rewards,

that is completely free (e.g., driving promotions, contest prizes etc.)

after you have received a notice of licence plate denial, or

for which 407 ETR, in its sole discretion, deems ineligible due to, for example, any misuse or abuse of ETR Rewards, our products or services.

Promotional Offers

From time to time, reward points may be offered in connection with our products and services, corporate partnerships or sponsorships. For example, you may receive a sign-up bonus simply for enrolling in ETR Rewards. Other offers may apply a bonus or multiplier to the reward points you earn on Eligible Trips or allow you to redeem Eligible Trips for a fraction of the typical reward points required. Where permitted by applicable law, reward points offered as part of a promotion may be subject to additional terms and conditions identified at the time of the offer which will apply in addition to the Terms.

From time to time, 407 ETR may provide for different promotional offers at the same time, whether related to ETR Rewards or not. You may be prevented from participating in more than one such promotional offer and accepting simultaneous offers, if permitted, may impact the number of reward points you can earn. For example, if you participate in 407 ETR’s free travel offers you may be automatically excluded from ETR Rewards offers and will not earn reward points on those zero-dollar trips. Each ETR Rewards offer is only valid once unless expressly stated otherwise in the terms of the offer. 407 ETR is not responsible for any errors that may occur in the sending, loading or displaying of reward point offers or if there is a delay in sending, loading or displaying such offers. We are not obligated to honour a request to earn or redeem reward points that were not earned or redeemed due to an error or delay in the sending, loading or displaying of offers.

Overdue Balances; Invalid Reward Points and Errors

If you have an account balance that is overdue by more than 161 days, you will not be able to earn or redeem reward points until after you pay off your overdue balance. Without limiting our rights under Section 7 (Termination & Suspension; Reward Points Forfeiture), if you earn reward points in a manner not permitted by the Terms, we may in our sole discretion and subject to applicable law, invalidate and remove such points from your rewards account. Note, the number of reward points displayed by 407 ETR on the App or otherwise may not reflect your current reward points balance according to 407 ETR’s records. To the extent permitted by law, we accept no liability for any errors in the reward points balance displayed. If any reward points are awarded in error for any reason, we may deduct such reward points at any time and without notice to you. We are not obligated to honour a request to redeem reward points added to your rewards account in error.

Records of Reward Points

Reward points may take up to 10 days after you complete an Eligible Trip to be processed and recorded. 407 ETR’s record of reward points earned, redeemed or deducted shall be deemed accurate. If you have a concern regarding your rewards account balance or wish to report a discrepancy, you must contact us and provide relevant evidence within 45 days from the corresponding date of travel, otherwise you will be deemed to agree with the reward points we have indicated.

Redeeming Reward Points

Reward points can only be redeemed through the App. To “redeem” means to use your reward points to pay for Eligible Trips. Reward points have no cash value and are not exchangeable for cash. Except as permitted from time to time by 407 ETR, reward points cannot be transferred, assigned, exchanged, purchased or given by gift. Reward points cannot be sold, traded, bartered, rented or otherwise disposed of, and are void if sold for cash or any other consideration.

You may redeem reward points toward one or more Eligible Trips identified in the App, up to the maximum points balance you have earned. You can only redeem reward points for the unbilled trips of a Qualifying Vehicle (limited to one redemption per trip). Please note, the cut-off time to redeem reward points for a trip is typically 3 to 5 days before you get your bill. Redemptions will appear on the next applicable bill (not necessarily the bill immediately following a redemption). Where individuals are consolidated under One Simple Bill, all redemptions will appear on that bill. Redeeming reward points earned by non-Qualifying Vehicles (i.e., those owned by other individuals) is prohibited.

You are responsible for all redemptions on your rewards account including any redemptions made in error or by others with access to your account, whether authorized by you or not, or any loss of reward points from your failure to follow reasonable privacy and security measures.

Redemption Restrictions

You cannot redeem reward points for trips taken:

in a vehicle other than a Qualifying Vehicle

in a vehicle weighing 5,000 kg or more

on roadways other than Highway 407 ETR

if you have an account balance that is more than 60 days overdue

after you have received a notice of failure to pay or a notice of licence plate denial

which 407 ETR, in its sole discretion, deems ineligible

Reward Points Expiration

To the extent permitted by law, all reward points in your account will expire 24 months after the date you last: (a) travelled on Highway 407 ETR; (b) earned reward points; or (c) redeemed reward points; whichever date is later. For example, if your last trip was in June 2026, you last earned points in July 2026, and you last redeemed points in August 2026, all your reward points will expire in August 2028. We will notify you at least 30 days, but not more than 60 days, in advance of your points expiring, specifying the date of expiry based on inactivity. Once reward points are expired, they cannot be reinstated.

Changes to ETR Rewards

We reserve the right to restrict, suspend or otherwise change any aspect, term or condition of ETR Rewards. We may modify all or one or more parts of the Terms at any time, such as:

The eligibility conditions and requirements for participating in ETR Rewards

The manner which a program member participates in ETR Rewards

The manner in which ETR Rewards is managed or administered, including any rights and obligations

The way in which reward points are earned, offered, redeemed, expired, invalidated or forfeited, including what is or is not considered an Eligible Trip

In the event the Terms, or an important aspect of ETR Rewards, is restricted, suspended or changed, where required by law, we will provide you written notice no less than 60 days and no more than 90 days from the effective date of the change. The notice will be sent through the App and/or via email and identify clearly and legibly the new clause and/or the amended clause and the clause as it was read formerly, the effective date of the change, and your rights. Your continued participation in ETR Rewards following such notice will constitute your consent to any amendments to these Terms or any other aspect of ETR Rewards.

Termination & Suspension; Reward Points Forfeiture

Where permitted by law, we may, at any time and without notice, suspend or cancel your participation in ETR Rewards if we determine that you have abused any program privilege, failed to follow the Terms, or made any misrepresentation to us. If your participation in ETR Rewards is suspended, the reward points in your account that were accumulated from abusing a program privilege, breaching the Terms, and/or making a misrepresentation may be forfeited and removed. If your participation in ETR Rewards is cancelled, all reward points in your account may also be forfeited and removed, regardless of the circumstances in which they were earned.

Subject to Section 7.a., we reserve the right to terminate or suspend ETR Rewards (or any part of it) on at least 60 days prior written notice through the App or via email. If ETR Rewards is terminated or suspended, you will have up to the period specified in the notice to redeem any reward points in your rewards account, and after such period any reward points that have not been redeemed will be forfeited.

We reserve the right to withdraw or temporarily change or suspend all or part of ETR Rewards in any way, in the event of a material error, omission, technical failure or change, computer virus or bugs, tampering, unauthorized intervention, fraud or any other cause beyond our reasonable control that interferes with the proper conduct of any aspect of ETR Rewards as set out in the Terms. Any attempt to deliberately damage any website or to undermine the legitimate operation of ETR Rewards in any way (as we may determine in our sole discretion where permitted by law) could be a violation of criminal or civil laws and should such an attempt be made, we reserve the right to seek remedies and damages to the fullest extent permitted by law.

We reserve the right to sell or transfer all or part of ETR Rewards to a related company or to a third party, to merge with another entity or to engage in any form of corporate, reorganization or financing transaction. In addition, the manner that ETR Rewards is provided to you may change.

There are specific situations in which your actions can result in the forfeiture of all accumulated reward points including, but not limited to: (i) if you opt out of ETR Rewards via the App, thereby terminating the Terms; (ii) if you wish to replace all your participating vehicles with those not registered in the exact same name as before (e.g., joint names, different surname); (iii) if you choose to delete your My Account, making you ineligible to participate in ETR Rewards, resulting in the permanent closure of your rewards account. You may, therefore, wish to apply your reward points to any Eligible Trips identified in the App prior to any of the foregoing situations. In addition, upon the death of a ETR Rewards member, the member’s rewards account will be closed and any reward points in the account will be forfeited. Reward points are not divisible in the case of divorce or equalization of family property.

Privacy & Security

407 ETR’s Privacy Notice applies to ETR Rewards and is available at 407etr.com. The Privacy Notice may be amended from time to time in accordance with its terms. Where permitted by law, by agreeing to the Terms, you are also agreeing to the terms of the Privacy Notice, and you undertake to review those terms, as such terms may be amended from time to time.

You acknowledge that it is your responsibility to use appropriate hardware and device settings, an updated operating system, and adequate connectivity services to allow for reliable and secure participation in ETR Rewards. You agree to store login credentials in a secure environment and to maintain strong passwords so that your account details remain private and confidential. Unauthorized or harmful activity from your failure to secure your network or login credentials will be your sole responsibility.

Release & Disclaimer

To the fullest extent permitted by law:

Your participation in ETR Rewards is at your sole risk, and you acknowledge that ETR Rewards is offered on an "as is" and "as available" basis. 407 ETR does not make or give any guarantee, representation, warranty or condition of any kind, whether express or implied, statutory or otherwise. 407 ETR disclaims all liability and responsibility for any act, omission or occurrence directly or indirectly caused by events outside of its control.

By participating in ETR Rewards, you agree to release and discharge us, our affiliates, shareholders, third-party service providers of ETR Rewards, and each of our and their respective officers, directors, agents, representatives, successors and assigns, from any loss, liability, claim, demand, damage or expense asserted by any person or entity relating in any way to ETR Rewards.

We are not liable or responsible in any manner for any tax consequences or any charge imposed by or with the authority of any government or governmental authority, which may flow from your participation in ETR Rewards.

If you breach the Terms and such breach causes 407 ETR or its affiliates any harm (financial, reputational, or otherwise), you agree to indemnify and hold harmless 407 ETR and its affiliates for any loss, liability, claim, demand, damage, or expense directly or indirectly suffered.

General

The Terms, together with 407 ETR’s Privacy Notice and any product, service, promotion, platform or channel -specific terms and conditions from 407 ETR, as applicable, form the entire agreement between you and 407 ETR as it relates to ETR Rewards, and supersedes all prior agreements or understandings of any nature whatsoever with respect to same. The headings in the Terms and its division into parts, paragraphs, sections and subsections are for convenience of reference only and do not affect the scope, intent, or interpretation of any provision hereof. Words in the singular form shall be construed to include the plural and vice versa and, unless otherwise required or specified, the word “including” means “including but not limited to”, and the word “days” refers to calendar days. Our failure to exercise any of our rights, powers or remedies in these Terms or at law, or any delay in doing so, does not constitute a waiver of those rights, powers or remedies. The single or partial exercise of a right, power or remedy does not prevent its subsequent exercise or the exercise of any right, power or remedy. Each of the provisions contained in the Terms is distinct and severable and a declaration of invalidity or unenforceability of any such provision or part thereof by a court of competent jurisdiction will not affect the validity or enforceability of any other provision of the Terms. You have required that these Terms, and all related documents, be drafted in English, at your express wish. A French version of these Terms has been provided to you. Except with respect to Quebec residents, the Terms and any additional terms and conditions referenced herein will be governed by and interpreted under the laws of Ontario and the federal laws of Canada, and any dispute, proceeding or claim arising out of or in connection with ETR Rewards is subject to the exclusive jurisdiction of Ontario courts.
